The Bombay High Court in Mumbai dismissed the plea for pre-arrest bail of a Mumbai developer who is accused of deceiving a doctor of Rs 90 lakh by promising a flat in a project at Parsi Colony, Wadala (West). The court noted the possibility of other victims and expressed concern over the situation faced by the unsuspecting investor. The court stated that the developer's conduct worsened the matter. The case involved Rajesh Jain of Neumac Group, who convinced Dr. Bharati Patil and her son, Dr. Nirmal, to invest in ‘Neumac Aura’ by offering a flat equivalent to twice the invested amount. However, upon visiting the site, the promised development was not evident. The developer failed to refund the money and reportedly issued threats. Charges were pressed against Jain for various offenses. Evidence presented showed that construction had not progressed as claimed. The court questioned the developer's honesty from the beginning and refuted claims of obstacles by the BMC. Despite issuance of necessary certificates, the promised project did not materialize as the investor had been led to believe.The new projected completion date was June 30, 2024. Justice Jamadar emphasized the importance of understanding the element of dishonest intention in light of these factors. He noted that Jain is trying to shift the blame for the delay onto others and is seeking pre-arrest bail based on intentions indicating fraud. The judge emphasized the need for Jain's detention for further questioning.
